Employers' Obligations from the Penal Point of View (Part I)

According to the data from the Statistical Office of the Republic of Slovenia for the last quarter of 2018, 807,000 people are in an employment relationship, meaning that labour law regulates the working life for a major part of the active population, however, it is evident from the 2017 report by the Labour Inspectorate of the Republic of Slovenia that employment rights are still too often violated. The article contains the substantive provisions presented in the light of the penal provisions of the Employment Relationships Act (ERA) in a way that each individual presentation covers one title of the chapter, the table showing the offense articles and substantive articles, the description of the offense and the text of the substantive article whose non-compliance represents an offence. The article is part one of the set of articles on employment-related offenses set forth in the ERA and includes a review of offenses related to the substantive provisions of Articles 1 to 76. Amendments to the existing legislation proposed by the Labour Inspectorate and related to the provisions addressed are also presented.
