Employers' Obligations from the Penal Law Perspective (Part III)

Abstract

In Slovenia, employment relationship is number one on the list of ways in which people work and earn money according to statistical data showing that 813,000 out of 991,000 people were employed in the second quarter of 2019. The article presents the substantive provisions relative to the penal provisions of the Employment Relationships Act (ERA), with each section including the title of the ERA chapter, offence articles and substantive articles, the description of the offence and the text of the substantive article whose non-compliance represents an offence. The article is part III of the set of articles on employment-related offences set forth in the ERA, and includes a review of offences related to the substantive provisions of Articles 143 to 212, with previous articles elaborated in part I, which was published in the Journal of Economic and Business Sciences (Vol. 6, No. 2, 2019), and in part II, which was published in the Journal of Economic and Business Sciences (Vol. 6, No. 2, 2019). In its annual report for 2018, the Labour Inspectorate proposed several amendments to the Employment Relationships Act, and the proposals connected with the content of this article are presented here.
